Terms of Service

1. Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and Potly (“Potly,” “we,” “us,” or “our”). By creating an account, submitting a report, or otherwise using Potly, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Potly.
2. What Potly does
Potly helps residents of the St. Louis region prepare and submit civic service requests (such as potholes, abandoned vehicles, and illegal dumping) to existing government portals. Potly is an independent service and is not affiliated with, endorsed by, or operated by any government agency, including the City of St. Louis Citizens’ Service Bureau (“CSB”). Potly is a free convenience tool, not a guarantee that any issue will be reviewed, accepted, or resolved by a government agency.
3. Your authorization (acting on your behalf)
When you submit a report, you authorize Potly to act as your agent for the limited purpose of completing and submitting that report — along with the information it contains, including your name, contact details, location, description, and photos — to the relevant government portal on your behalf. You confirm that you have the right to provide that information and to authorize its submission.
You may stop using Potly at any time. Once a report has been submitted to a government agency, Potly cannot recall, edit, or delete it — it is handled by that agency under its own policies and applicable public-records laws.
4. Your responsibilities
You agree that you will:
- Provide information that is accurate, truthful, and your own (or that you are authorized to submit).
- Submit reports only for genuine civic issues, and not submit false, misleading, duplicate-spam, harassing, or unlawful reports.
- Not misuse the service — including no automated scraping, overloading, reverse engineering, or attempts to disrupt or gain unauthorized access to Potly or the government portals it submits to.
- Be at least 13 years old to use Potly.
Submitting knowingly false reports to a government agency may carry legal consequences for which you, not Potly, are responsible.
5. Accounts
You are responsible for the activity under your account and for keeping your credentials secure. You can create an account or submit certain reports as a guest. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used to abuse the service or the government portals.
6. Content you provide
You retain ownership of the descriptions and photos you provide. You grant Potly a limited license to store, process, and transmit that content as needed to operate the service and to submit your report as you direct. Do not upload content you do not have the right to share. Photos may be stored in a location that is accessible by URL — see the Privacy Policy for details — so avoid including sensitive personal information in them.
7. Third-party services and portals
Potly relies on third-party providers and submits to government portals it does not control. We are not responsible for the availability, accuracy, decisions, response times, or conduct of any government agency or third-party service, or for changes they make that affect Potly’s ability to submit reports.
8. Disclaimers
Potly is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that reports will be successfully delivered to or acted on by any agency, or that any civic issue will be resolved.
9. Limitation of liability
To the fullest extent permitted by law, Potly and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the service, from any report’s submission or non-submission, or from the action or inaction of any government agency. Potly is a free service; to the extent any liability is found, it will not exceed one hundred U.S. dollars (US$100).
10. Indemnification
You agree to indemnify and hold harmless Potly and its operators from any claims, losses, or expenses arising out of the content you submit, your violation of these Terms, or your misuse of the service.
11. Changes to the service and these terms
We may modify or discontinue the service, and we may update these Terms from time to time. When we make material changes, we will revise the “Effective date” above. Your continued use of Potly after an update means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in St. Louis, Missouri will have exclusive jurisdiction over any dispute that is not otherwise resolved.
